Johnathan Bailey is a highly qualified and experienced litigator and advisor focused on all aspects of doing business with the Federal Government and the State of Texas. In his role as litigator, Johnathan’s daily practice particularly focuses on bid protests, contract claims, and prime/subcontractor disputes. In his role as an advisor, Johnathan’s daily practice involves contract and teaming agreement drafting as well as in-depth analysis and advice of contract documents, and federal contracting regulations including the FAR, SBA’s regulations and the Department of Labor’s Davis-Bacon and Service Contract Act regulations. Johnathan’s experience makes him uniquely qualified to guide your company through the sometimes treacherous waters of public contracting.

Johnathan’s experience and expertise includes:

Prosecuting and defending bid protests, including more than 200 bid protest cases before the Government Accountability Office, the United States Court of Federal Claims;Preparing and prosecuting contract claims, including complex construction claims;Defense of contractors in suspension and debarment proceedings;Representation of contractors in Service Contract Act and Davis-Bacon Act violation proceedings before the Department of Labor;Drafting and negotiation of teaming agreements, confidentiality agreements, and subcontracts relating to federal and state public contracts;Prosecution and defense of Miller Act cases across the country;Advising clients on and preparing SBA 8(a) Program applications, drafting Mentor-Protégé agreements, and representing 8(a) Program participants with respect to continuing eligibility and challenges to that eligibility;Prosecution and defense of size protests, NAICS appeals, HUBZone status protests, SDVO status protests and similar administrative litigation relating to SBA programs;Advice and representation before SBA with respect to the HUBZone Program, the Service-Disabled Veteran Owned-Business Program, the Woman-Owned Business Program, the Small Disadvantaged Business Program;Representation of Alaskan Native Corporation-owned companies and firms who contract with ANC-owned companies;Litigation of Texas construction law disputes including preparation and foreclosure of mechanics liens, construction arbitration, and litigation of prime/subcontractor payment disputes.

Johnathan earned his undergraduate degree at the University of Texas at Austin and obtained his law degree from St. Mary’s School of Law. Johnathan was admitted to practice law by the State Bar of Texas in 1996.
