|Areas of Practice|
Lawrence Boesch brings a unique perspective to civil litigation in the commercial context, having worked for creditors for fifteen years, before representing debtors for the next eight years. He practices primarily in California state court, having sought and opposed writs of attachment, temporary restraining orders, injunctions, and conservatorships.
He also represented claimants and respondents in employment, tenants’, and bankruptcy disputes. He has taken the defense of an alleged batterer through jury trial and the defense of an alleged defrauder through binding arbitration. His depositions assisted in the settlement of plaintiffs’ personal injury cases. He presented an effective commercial property-owner’s damage claim before a panel of court-appointed neutrals to collect for vandalism under an insurance policy.
Mr. Boesch also has used summary judgment and summary adjudication of issues procedures to avoid trial and get the parties’ a more cost-effective result. His familiarity with the standard of care for legal practice has given him experience in both prosecuting and defending legal malpractice claims, which require proof both that the client’s claim or defense was viable and that the attorney’s handling was or wasn’t effective.
Mr. Boesch earned a Martindale-Hubbell Law Directory rating of "B-V" while managing his own office for nearly six years, during which he also settled cases involving real estate controversies involving allegations of constructive trusts, lot-line disputes, easement controversies, preemptive rights (of first refusal), post-earthquake construction defects, and sellers’ nondisclosure of property defects.
Lawrence was a court-appointed arbitrator and early neutral evaluation ADR referral in Santa Clara County for nearly twenty years before relocating to Southern California to work for the Law Offices of Barry K. Rothman. His specialty is preparing pretrial and trial written motions, conducting, responding to and enforcing discovery of documents, information and legal theories.
His work in appellate courts has included briefing for both the appellant and the respondent. He has represented petitioners in probate court and has negotiated commercial real estate purchase contracts.
Mr. Boesch received his J.D. from Golden Gate University School of Law in San Francisco in 1983. His degrees in philosophy are an M.A. (San Francisco State University) and a B.A. (Catholic University, Washington, D.C.) He wrote two articles that were published in the Los Angeles County Bar Association’s monthly publication, L.A. Lawyer, one regarding “Defense Strategies in Contract Cases Ignoring Arbitration Clauses” and the other discussing the “Magnificent Exceptions (To the Statute of Frauds).”
A member of the Association of Business Trial Lawyers, the Los Angeles County Bar Association, the Beverly Hills Bar Association (Entertainment Law section) and the Santa Clara County Trial Lawyers Association, Mr. Boesch and his wife live in West Los Angeles; their children are fully-employed graduates of the University of California.
