Description

Michael Ellement has represented employees who have been sexually harassed and sexually assaulted at work; discriminated against because of their gender, race, and age; and whistleblowers who have been unlawfully fired after uncovering misconduct.

Prior to joining Bernabei & Kabat, Mr. Ellement worked as an attorney for the National Labor Relations Board, Office of General Counsel, where he represented the rights of workers who were discriminated against in violation of federal law. He litigated complex matters in federal courts throughout the country. He argued before the 2nd, 5th, and DC Circuits, and in several district court proceedings.

Before working at the NLRB, Mr. Ellement clerked for the Honorable Judge Ivan L.R. Lemelle of the United States District Court for the Eastern District of Lousiana, in New Orleans.

Mr. Ellement is an accomplished author and legal scholar in the areas of constitutional law, election law, civil rights litigation, and labor law. His work has appeared in a number of prominent legal journals, including the Yale Law and Policy Reviewer’s Inter Alia and the American Bar Association’s Labor and Employment Law Journal. He has been cited in journal articles, legal briefs, textbooks, and before the United States Senate.

Mr. Ellement is a 2013 graduate of the Catholic University of America, where he was a member of the school’s law review. He additionally was a member of the Trial and Moot Court teams, and won two national competitions – the 2012 Wechsler Moot Court hosted by the University of Buffalo (which focused on criminal and constitutional law) and the 2013 National Ethics Trial Competition hosted by the University of the Pacific (which focused on legal ethics and evidence law).

He is also a 2010 graduate of Siena College. At graduation he was awarded Siena’s two highest student honors, the Fr. Mensing Award and Senior Service Award.

Mr. Ellement has been admitted to the Maryland bar and District of Columbia bar.
