Kimberly C. Lau’s practice focuses on commercial litigation. Ms. Lau’s practice includes complex commercial litigation, professional liability, employment litigation, judgment enforcement, contract disputes, securities litigation, debtor creditor law, and intellectual property.

Ms. Lau was born and raised in Honolulu, Hawaii. She received her B.A. summa cum laude in 2003 from Syracuse University and her J.D. in 2006 from Syracuse University College of Law as a Chancellor’s Scholar. While in law school, Ms. Lau was a law clerk for the United States Attorney’s Office, Northern District of New York and clerked for Hon. Judge Craig H. Nakamura of the Intermediate Court of Appeals of Hawaii. Ms. Lau has successfully argued cases before various judges in the New York Supreme Courts and successfully appealed a case involving the improper discharge of a mechanic’s lien to the New York Appellate Division, Second Department. As a result of her experience in the judiciary and in the private sector, Ms. Lau brings a thorough understanding of the entire litigation process. Ms. Lau also has a background in criminal defense and is a licensed real estate broker in the State of New York.

Representative Matters:

Represents a partner in a multi-million dollar lawsuit against 38 partnerships seeking redress for a 20-year ongoing fraudulent scheme carried out by her fellow partners, including her own husband, to divert income and distributions and transfer assets without her knowledge or consent. Successfully obtained a restraining order on behalf of 47% of a family-owned partnership to prevent the improper sale of the partnership’s sole asset, namely, a Laundromat located in Brooklyn, New York, and the appointment of a temporary receiver in contravention of the partnership’s agreement and under partnership law. Represents minority 13.33% partner in an arbitration to obtain recovery against majority partners of the tripartite partnership owning interests in two NYC hotels for their diversion of claimant’s share of all distributions and/or profits from all capital events with respect to either of the Hotels in contravention of the partnership agreement, after claimant’s discovery of majority partners’ multiple refinances, assignments and sales of the two hotels disclosed in a public records search. In an Internet defamation action, represents an individual seeking redress for a litany of libelous posts made by an anonymous blogger on a political website. Represents the Estate of a deceased partner in a $2 million dollar partnership dispute in a multi-party arbitration. Represented a subcontractor on an appeal to the Second Department regarding the improper discharge of a mechanic’s lien. Represented a judge defending against claims of improper courtroom decorum before the Commission on Judicial Conduct. Represented an investment bank in an arbitration regarding a investor brokerage fee. Represented a corporation against a major poultry supplier in trademark, unfair competition and breach of contract claims. Represents a well-known fiction author involved in a contract dispute with an international publishing company. Represents majority members of a limited liability company defending against claims of breach of contract, breach of fiduciary duties and unjust enrichment involving the operation of a large ski resort in Vermont. Represented an investor in defending against a clawback action for allegedly receiving false profits from a $30 million Ponzi scheme. Represented an attorney defending against notarial fraud in a $19mm real estate transaction.
