Finks Farm, Inc. v. E.I. Du Pont de Nemours & Company, Et al.

Court: Finks Farms, Inc. v. Du Pont, et al., was an agricultural products liability matter involving the Du Pont Fungicide, Benlate 50 DF. This matter was tried to the Jury, with a jury finding the product defective and awarding damages to Finks Farms. It was appealed to the Second District Court of Appeals and resulted in the only written opinion out of hundreds of claims filed regarding the fungicide, Benlate 50 DF.

The Coca-Cola Company v. State of Florida Department of Agriculture and Consumer Affairs.

Court: Circuit Court, Highlands County, Florida. This was an action against the State of Florida for improperly destroying citrus plant stock of the client, as well as improperly destroying numerous citrus nurseries across the State of Florida. The matter was resolved by the State of Florida for reason no citrus canker was present and Burn Orders destroying stock were issued erroneously. The alleged citrus canker was, in fact, a harmless leaf spot.

Shady Grove Farms, Inc. v. Goldsmith Seeds, Inc.

Court: United States District Court for the Middle District of Florida. Shady Grove Farms, Inc., alleged it was sold the wrong variety of cherry tomato seed by Goldsmith Seeds, Inc. At Trial we were able to demonstrate that wrong variety of seed had been sold to Shady Grove Farms, resulting in large, non-marketable cherry tomatoes.

Culbro Corporation, d/b/a/ Imperial Nurseries, Inc. v. Du Pont, et al.

Court: United States District Court for the Northern District of Florida. Culbro Corporation v. Du Pont was an agricultural products liability matter involving the Du Pont fungicide, Benlate 50 DF. This matter involved alleged injury to woody ornamental nursery stock by the Du Pont fungicide, Benlate 50 DF. It is included to reflect that our litigation has involved ornamental nurseries as well as citrus stock and vegetable growers.

Phillip Jones, et al., d/b/a/ J & B Tomato, Inc. v Asgrow Seed Company.

Court: United States District Court for the Northern District of Ohio. J & B Tomato, Inc., and its individual growers alleged they were sold tomato seed which was infected with bacterial tomato canker (clavibactermichiganensis) and the virus, which flourishes in Ohio, spread from infected plants to numerous locations, causing crop devastation.

Hershel Smith, Jr., et al v. Asplundh Bush Control Company, et al.

Court: Circuit Court of Jefferson County, Alabama. This is an action involving our representation of vegetable farmers on Chandler Mountain, which is North of Birmingham, Alabama, where herbicide drift from a utility road crew damaged crops.
