NOTABLE LITIGATION

Quizno’s Parent Company (QCE Finance LLC) et al. v. Client

Won first phase of bifurcated trial, successfully assigning liability to franchisor for fire that destroyed clients’ commercial building in Monterey, Calif., leading to multi-million-dollar settlement in favor of cross-complaining client on the eve of the second phase of the trial. Successfully accomplished the completion of settlement payments to client despite the losing party’s subsequent bankruptcy.

Client v. Trustees of Lee Family Trust

Won arbitration phase of specific performance action regarding client-buyer’s $4.5 million purchase of a mixed-use commercial building in San Francisco after sellers breached sales contract. Successfully argued for an arbitrator’s judgment requiring seller to transfer title, and reduce the sales price by several hundred thousand dollars, attributable to the amount of rental income buyer would have been entitled to over the two-year period during which seller refused to transfer title.

Client v. Bolle

Successfully represented elder’s trust in retrieving in excess of $1 million (plus interest) from adult nephew who failed to provide security for, and failed to repay, loaned money he used to purchase multiple investment properties for his own benefit located throughout California and Alaska.
