Jim, a founding member of the firm, is its managing partner. He serves as the counsel for privately held businesses and public entities. He regularly represents clients concerning restrictive covenants, wrongful termination claims, harassment claims, civil rights claims, defamation, and contract disputes. He also represents clients before administrative agencies such as the Office of Administrative Law, New Jersey Civil Service Commission, Wage and Hour, Unemployment, agencies overseeing New Jersey pensions, and the Public Employment Relations Commission.

He has handled numerous investigations alleging sexual harassment in the workplace, claims of discriminatory practices based upon age, race and/or disability by supervisors, alleged retaliation to whistleblowers and other alleged wrongful employment practice claims. Many of these types of claims result in litigation, which Jim has handled on many occasions.

He works with employers to draft employment agreements for employees, restrictive covenants, which help protect an employer’s proprietary interests including client lists, marketing plans and other confidential information. These agreements can also contain stock option agreements, commission arrangements, and other compensation programs.

He is also experienced in traditional labor law and has negotiated collective bargaining agreements for private employers and public entities; as well as conducted numerous interest and grievance arbitrations.

He has specialized knowledge on constitutional issues that affect businesses such as free speech concerns of employers and employees, search and seizure laws, privacy of data, ownership of information contained on company-owned computers and religious issues in the workplace.

He has lectured on the impact of recent case law for claims in administrative agencies, claims of disability discrimination, administrative remedies for ADA, Title VII and other federal statutes and on the employment-at-will doctrine. He has been published on what employer considerations should be before including arbitration clauses in contracts and employment agreements.

Jim is licensed in New Jersey, New York, and Pennsylvania, as well as federal courts in each State. He is also licensed to practice before the United States Supreme Court.
