Theodore W. Small, Jr. practices in the areas of employment law and commercial litigation. He represents and advises employers in race, sex, sexual harassment, age and disability discrimination matters arising under employment contracts, the ADEA, FMLA, FLSA, ERISA, Title VII of the Civil Rights Act of 1964, and other local, state and federal employment statutes.

Mr. Small’s litigation experience includes two major civil rights cases, Isaiah Webb v. District of Columbia, 175 F.R.D. 128 (D.D.C. 1997) (race and gender discrimination and retaliatory discharge claims), and Concerned Parent of Jordan Park v. The Housing Authority of the City of St. Petersburg, 934 F. Supp. 406 (M.D. Fla. 1996) (lead-based paint housing, 42 U.S.C. 4801 et seq., and 1983 claims). His appellate litigation experience includes several oral arguments before the Second District Court of Appeals, State of Florida and briefing many other appeals and petitions for writs in D.C. and Florida.

While on a full-time rotation with Holland & Knight’s Community Services Team, Mr. Small developed and coordinated the firm’s Adopt-A-Neighborhood project which encompasses corporate, tax, legislative and litigation assistance to non-profit groups in D.C.’s Shaw Urban Renewal Area. He also represented the survivors and direct descendants of the 1923 Massacre in Rosewood, Florida by monitoring the State of Florida’s compliance with the 1994 Claims Bill and by providing general advice and counsel to the Rosewood Justice Center, Inc.

Mr. Small is currently a member of The Florida Bar, the District of Columbia Bar, the Eleventh Circuit Court of Appeals Bar, the United States Court of Appeals for the District of Columbia Circuit, the District of Columbia Circuit Court of Appeals Bar, the Middle District of Florida Bar, the District for the District of Columbia Bar, the United States Federal Claims Court Bar, the Columbia Bar, the United States Federal Claims Court Bar, the National Bar Association, the American Bar Association and the Florida Chapter of the National Bar Association. His significant activities include co-chairing the Public Schools Committee of the ABA Section of Individual Rights and Responsibilities, and tutoring at Cleveland Elementary School in the Shaw Urban Renewal Area of Washington, D.C. He also serves on the Selection Committee for the University of Virginia School of Law Dillard Scholar Program, and the Selection Committee for the Ron Brown Scholar Program which is sponsored by the CAP Foundation.
